By accessing or using AiWitness, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the platform. These Terms constitute a legally binding agreement between you and AiWitness, Inc. Your continued use of the platform after any updates to these Terms constitutes acceptance of the revised Terms.
AiWitness is a civil rights protection platform that provides real-time legal information, automated evidence documentation, community witness coordination, and connection to licensed attorneys. The platform operates in two primary modes: Rights Mode (designed for police encounters) and Civil Mode (designed for protests and demonstrations). AiWitness is a technology service and does not itself provide legal representation.
You must be 18 years of age or older to create an account and use AiWitness. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration. Only one account per person is permitted. AiWitness reserves the right to suspend or terminate accounts that violate these Terms or that engage in fraudulent or harmful behavior.
You may use AiWitness only for lawful purposes and in accordance with these Terms. The following uses are strictly prohibited:
AiWitness provides legal INFORMATION, not legal ADVICE. The platform does not create an attorney-client relationship between you and AiWitness or any of its employees. Information provided during encounters — including AI-generated legal guidance — is for educational purposes only and may not reflect the laws of your specific jurisdiction. Always consult a licensed attorney for legal advice specific to your situation. Do not rely solely on AiWitness during any encounter.
You own your recordings and evidence packages. AiWitness stores them encrypted on your behalf. You may download and delete your data at any time from your account settings. AiWitness does not sell, license, or share your evidence data with any third party without your explicit written consent, except as required by a valid court order or applicable law. The AiWitness Community Witness Network is composed of volunteer community members. AiWitness does not guarantee witness availability, response time, or the quality of witness corroboration. Witness participation is subject to separate Community Witness Guidelines. Witnesses act independently and are not employees or agents of AiWitness.
Attorneys accessible through AiWitness are independent licensed professionals. Connection through the AiWitness platform does not create an attorney-client relationship until the attorney explicitly confirms engagement with you. Attorney fees are separate from AiWitness subscription fees. AiWitness does not guarantee attorney availability or any particular legal outcome.
AiWitness offers a free tier with core protection features and paid subscription tiers with advanced features including enhanced evidence storage, priority attorney matching, and expanded witness network access. Paid subscriptions are billed monthly or annually. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are issued at our discretion for requests made within 7 days of a charge. Prices may change with 30 days' notice.
AiWitness, its logo, and all platform features, software, and interfaces are owned by AiWitness, Inc. and protected by applicable intellectual property laws. You retain all rights to the content you create and upload. By using AiWitness, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely to provide the service to you.
Your use of AiWitness is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully. By using AiWitness, you consent to the data practices described in the Privacy Policy.
AiWitness is provided "as is" without warranties of any kind. To the maximum extent permitted by law, AiWitness is not liable for: (a) failure of recordings due to device issues, network outages, or third-party factors; (b) attorney outcomes or legal results; (c) witness network failures or non-responsiveness; (d) any indirect, incidental, special, or consequential damages. Our maximum liability to you for any claim is limited to the total fees paid by you to AiWitness in the 12 months preceding the claim.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of AiWitness will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. When we make material changes, we will notify you by email and via in-app notice at least 30 days before the changes take effect. Your continued use of AiWitness after the effective date of updated Terms constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using AiWitness before the effective date.
