Privacy Policy

Effective Date: July 1, 2026

1. Information We Collect

We collect the following categories of information when you use AiWitness:

  • Account information: Your name, email address, and password (hashed).
  • Device information: Device model, operating system version, and unique device identifier.
  • Usage data: Features used, session length, and in-app actions — collected to improve the platform.
  • Evidence data: Audio, video, GPS coordinates, and AI-generated transcripts — collected only with your explicit activation of Rights Mode or Civil Mode.
  • Location data: GPS location, only during active encounter sessions with your permission.
  • Payment information: Processed by Stripe. We do not store your card numbers or full payment details.

2. How We Use Information

We use the information we collect to:

  • Provide, maintain, and improve the AiWitness platform
  • Send security alerts and important account notifications
  • Process subscription payments and billing
  • Connect you with attorneys (with your explicit consent during an encounter)
  • Generate anonymized, aggregate analytics to improve platform performance and reliability

We do not sell your personal information to any third party for advertising or marketing purposes.

3. Evidence Data

Your evidence packages — including audio, video, transcripts, GPS data, and AI analysis — are encrypted at rest using AES-256 encryption. We never sell, rent, share, or license your evidence data. Law enforcement access to your evidence data requires a valid court order or subpoena; we will notify you of any such request unless we are legally prohibited from doing so. You can export or permanently delete all evidence data at any time from your account settings. Deletion is irreversible.

4. Location Data

Location data is only accessed during active Rights Mode or Civil Mode sessions, with your explicit permission. We do not track your location in the background when you are not in an active session. Location data captured during encounters is included in your evidence package, under your control. You can delete your evidence packages (including location data) at any time.

5. Community Witness Data

When you participate as a witness in the Community Witness Network, your identity is not disclosed to the person you are witnessing. Your location information is shared only as an approximate radius (not an exact address) to enable proximity matching. Witnesses are notified of the general area of an encounter but not the precise address of the person requesting witnesses.

6. Attorney Network Data

If you request attorney connection during or after an encounter, we share an encounter summary — including the nature of the encounter, severity classification, and relevant legal flags — with matched attorneys in our network. We do not automatically share full audio or video recordings. You explicitly control what is shared with any attorney prior to establishing an engagement.

7. Data Retention

We retain your data for the following periods:

  • Account data: Retained while your account is active.
  • Evidence packages: Retained until you delete them.
  • Anonymized usage data: Up to 2 years from collection.

Upon account deletion, all personal data associated with your account is permanently deleted within 30 days, subject to any legal hold obligations.

8. Data Security

We take data security seriously and implement the following measures:

  • AES-256 encryption for all data at rest
  • TLS 1.3 for all data in transit
  • Regular third-party security audits
  • Annual penetration testing by independent security researchers
  • SOC 2 Type II compliance in progress

9. Your Rights

You have the right to access, export, correct, or delete your personal data at any time through your account settings. California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected and the right to opt out of sale (we do not sell personal information). EU and UK residents have rights under the General Data Protection Regulation (GDPR), including rights to restriction, portability, and objection. 10. Children's Privacy

AiWitness is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected data from a child under 18 without parental consent, we will delete that information promptly. If you believe we may have collected information from a minor, please contact us immediately at privacy@aiwitness.app.

11. Changes to Policy

We will notify you of material changes to this Privacy Policy by email and via in-app notification at least 30 days before the changes take effect. Non-material changes (such as clarifications) may be made at any time. We encourage you to review this policy periodically.
